A lawyer, Diego sailed for Peru, where he acquired lands and mines and became a prominent figure there. After his appointment in Potosí ended, he worked as a lawyer in Lima before moving to Huánuco, where he met his wife. He amassed a great fortune and was a benefactor to the town and gave full support to the Augustinians who settled there in 1584.

Son of García Álvarez de Toledo and Inés de la Fuente, he married Isabel Velásquez (daughter of Gaspar de Vega and Eulalia Velázquez), and had no issue.
